Top Spin Hero is a tennis match coordination platform that helps organizers manage groups of players, schedule matches, and communicate through SMS and WhatsApp messaging services.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account by providing your phone number and verifying it via SMS code. You agree to provide accurate information and keep your account secure.

3.2 Account Types

  • Organizers: Users who create and manage tennis groups. Organizers use the Service for free.
  • Players: Users invited to tennis groups. Players pay a monthly subscription fee of $2.99 USD.

4. SMS/Text Messaging Terms

4.1 Consent to Receive SMS Messages

By providing your phone number during account registration on our website (topspinhero.com), you expressly consent to receive recurring automated SMS text messages from Top Spin Hero at the phone number provided. This consent is not a condition of purchasing any goods or services.

Consent is obtained via our website when you:

  • Enter your phone number in the sign-up or login form
  • Check the SMS consent checkbox
  • Receive and enter the SMS verification code
  • Complete account creation or join a tennis group

By completing this process, you acknowledge that you have read and agree to these SMS terms and our Privacy Policy.

4.2 Types of SMS Messages

You will receive the following types of text messages:

  • Verification Codes: One-time codes to verify your phone number during login
  • Match Invitations: Notifications about upcoming tennis matches in your groups
  • RSVP Confirmations: Confirmations when you accept or decline match invitations
  • Reminders: Reminders about upcoming matches you've accepted (24h and 2h before)
  • Schedule Changes: Updates about time, location, or cancellation changes
  • Score Reports: Match results and statistics after games

4.3 Message Frequency

Message frequency varies based on your group activity. Typical users receive 2-10 messages per week depending on how many groups you belong to and how often matches are scheduled.

4.4 Message and Data Rates

Message and data rates may apply. Please consult your wireless carrier's pricing plan for details. Top Spin Hero is not responsible for any charges from your carrier.

4.5 How to Opt Out (STOP)

You can stop receiving SMS messages at any time by:

After opting out, you will receive one final confirmation message confirming your unsubscription. Note: Opting out may affect your ability to participate in tennis matches as you will not receive invitations.

4.7 Supported Carriers

SMS messages are supported on all major US wireless carriers including AT&T, Verizon, T-Mobile, Sprint, US Cellular, and regional carriers. Carriers are not liable for delayed or undelivered messages.

5. WhatsApp Messaging Terms

We may also send messages via WhatsApp Business API. By using our service, you consent to receive WhatsApp messages including match invitations, reminders, and updates. The same opt-out methods apply. WhatsApp requires the WhatsApp app and an active internet connection.

6. Payment Terms

6.1 Player Subscriptions

Players are charged $2.99 USD per month to participate in tennis groups. Subscriptions are billed monthly and can be canceled at any time.

6.2 Refunds

Subscription fees are non-refundable. If you cancel your subscription, you will continue to have access until the end of your current billing period.

7. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Send spam or unsolicited messages
  • Attempt to gain unauthorized access to the Service
  • Interfere with the proper functioning of the Service

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Top Spin Hero and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Top Spin Hero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

11. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

13. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
